In an article published in the most recent edition of the Irish Jurist, Dr. Luke Danagher examines the mens rea of cartel crime in Ireland. Dr. Danagher’s research calls for a reformulation of current legislation governing cartel activity in Ireland, specifically the introduction of a mens rea of intention into the cartel offence. The aim of this proposed redrafting of the cartel offence is to ensure the fair criminalisation of corporate wrongdoers, to minimise the potential for misapplication of the cartel offence, and to attach a more appropriate mens rea standard to a serious and stigmatic corporate crime.
